Coaching Agreement

A. To clarify the services of The Program and relationship, Client (you) and Coach (Jennifer Cui) acknowledge and agree that:

1. The coaching services are provided via Zoom Meeting, email, text message, and/or other communication application platform.

2. The Client can expect me, the Coach, to be honest and direct, ask straightforward, clarifying questions and use challenging techniques, and make empowering requests to help you move forward. Throughout our working relationship, the conversations will be very direct and personal. The purpose of our interaction is to hold the Client’s focused on his or her desired outcome and to coach the Client to stay clear, focused, and in action.

3. The Client is guaranteed confidentiality with the exception of any expression of suicidal ideation, or if there is anything disclosed to the Coach that would put the Client or anyone else at potential harm. In this exception, the Client’s emergency contact will be notified, along with any pertinent individuals including but not limited to the local and state police, school staff, and parental guardians. It is important for the integrity and value of our coaching relationship that we are open and honest with each other. You are free to share whatever you choose from our sessions with anyone, with the exception of electronic and physical files that may not be copied and shared. I will only release information about our work to others with your prior verbal or written permission, or if I am required to do so by law. Because absolute confidentiality cannot be guaranteed in electronically transmitted communication, please let me know of any preferences you have regarding the use of email or phone.

4. The Client can expect, and is guaranteed, confidentially extended to responses shared on any questionnaire, survey, inventory, or assessment, unless the Client gives explicit permission to share their information with the Coach.

B. Client duties, representations and understanding of coaching:

1. I understand that coaching is a relationship which is designed and defined by the Client with the Coach’s agreement, and which is based on the Client’s expressed interests, goals, and objectives.

2. I understand the purpose of coaching is to develop and implement strategies to help me, the Client, reach personally identified goals of enhanced performance and personal satisfaction. I understand the Coach will use discussion, questions and requests to assist me, the Client to identify personal and/or business goals; develop strategies and action plans intended to achieve such goals; and monitor progress towards implementation of the action plans. Coaching may address a wide variety of goals, challenges, and topics including, but not limited to: mental health, spirituality, addiction, drug use, sensitive information, specific personal projects, physical fitness, life balance, food anxiety, self-care, social detoxification, life satisfaction, or general conditions in the client's life, health, academics, or profession.

3. I understand that coaching does not involve the diagnosis or treatment of mental health issues as defined by the American Psychiatric Association. I understand that coaching is not a substitute for psychotherapy, psychoanalysis, mental or physical health care, or substance abuse treatment. I understand that I am fully responsible for all my decisions, actions and feelings, as well as seeking out professional mental health care if needed.

4. I understand I am responsible for my own achievements and success and that my Coach cannot and does not promise that you, the Client, will take any specific action or attain specific goals. I understand that I, the Client, helps clarify direction, guides decision making, and implement action in order to achieve my goals.

5. I understand that as the Client, I help set the agenda for my coaching, and my success will depend on my willingness to define my goals, take risks, and try new approaches. If the coaching is not working as I wish, I am empowered to inform my Coach so we can both take steps to correct the problem. Like any human endeavor, coaching can involve feelings of distress and frustration which accompany the process of change.

6. I understand my Coach will assist me in developing strategies to maintain the changes I, the client, seek and that my Coach will support, encourage, teach, and help me stay "on track" toward reaching my goals by assigning homework, recommending strategies and practices. If I do not follow through with the homework assignment(s), or the spirit of the homework assignment(s), I understand I, the Client, am responsible for my decision to stay with the status quo. I am fully aware and understand that coaching does not offer any guarantee of success.

C. Disclaimers

1. The Client understands that the role of the Coach is not to prescribe, assess, diagnose, treat or cure any disease, condition or other physical or mental ailment of the human body. Rather, the Coach is a mentor and guide who has been trained in general life coaching to help clients reach their own life, wellness, career, relational, and spiritual goals by helping clients devise and implement positive, sustainable lifestyle changes and a supportive mindset. The Client understands that the Coach is not acting in the capacity of a medical doctor, licensed dietician-nutritionist, psychologist or other licensed or registered professional, and that any advice given by the Coach is not meant to take the place of advice by these professionals. If the Client is under the care of a health care professional or currently uses prescription medications, the Client should discuss any dietary changes or potential dietary supplements use with his or her doctor, and should not discontinue any prescription medications without first consulting his or her doctor.

2. The Client has chosen to work with the Coach and understands that the information received should not be seen as medical or nursing advice and is not meant to take the place of seeing licensed health professionals.

D. Personal Responsibility and Release of Health Care Related Claims

1. The Client acknowledges that the Client takes full responsibility for the Client’s life and well-being, as well as the lives and well-being of the Client’s family and children (where applicable), and all decisions made during and after this program.

2. The Client expressly assumes the risks of the Program, including the risks of trying new foods or supplements, physical fitness routines or exercises, and the risks inherent in making lifestyle changes as well as risks associated with any financial, professional, and romantic decisions associated with thought and feeling changes. The Client releases the Coach from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which the Client ever had, now has or will have in the future against the Coach, arising from the Client’s past, current, or future participation in, or otherwise with respect to the Program, unless arising from the gross negligence of the Coach.

E. Physical Exercise Waiver & Release

  1. Because physical exercise can be strenuous and subject to risk of serious injury, the coach urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. You agree that by participating in physical exercise or training activities, you do so entirely at your own risk.

  2. Any recommendations for changes in diet including the use of food supplements, weight reduction and/or body building enhancement products are entirely your responsibility and you should consult a physician prior to undergoing any dietary or food supplement changes. You agree that you are voluntarily participating in these activities and use of the program and the exercise facility of your choice and assume all risks of injury, illness, or death.

  3. You expressly agree to release and discharge the coach from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against the trainer or instructor for personal injury or property damage. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence.

  4. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.

F. Financial Agreement:

By completing the payment the Client agrees:

1. I [the Client] am responsible for the full payment of fees for the entire course of the program, regardless of whether I actually attend or complete the program, once the payment is made. I recognize it is in my best interest to show up for the calls and participate fully. No refunds or returns will be made, no exceptions.

2. CANCELLATION POLICY: Sessions may be rescheduled if a minimum of 24 hours advance notice is given. I (the client) understand if I miss any scheduled coaching sessions, I will lose that session and will not be able to reschedule it. If no cancellation notice is given or client misses the session or is late, the client is still responsible for the full session cost and the time of the session will not be extended or made up in any other session.

2. I [the Client] understand all surveys, assessments, exercises, video, electronic and printed materials provided by the coach, Jennifer Cui, are the intellectual property of Jennifer Cui and may not be copied, given to others, forwarded by email to others or used without written permission of Jennifer Cui.
